1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the RobThumbnail website and services at robthumbnail.com (the "Service"), operated by RobThumbnail ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that entity to these Terms.

3. The Service

RobThumbnail is an AI-powered studio for creating thumbnails for Roblox games. You describe what you need in a chat, and the Service uses third-party AI models to generate and refine images based on your instructions.

We are not affiliated with, endorsed by, or sponsored by Roblox Corporation. "Roblox" is a trademark of Roblox Corporation. Any use of Roblox trademarks in generated content is your responsibility, and generated content must comply with Roblox's Community Standards when used on Roblox platforms.

4. Accounts and Security

You may create an account using an email address and password, or by signing in with Google. You agree to provide accurate and complete information, to keep your credentials confidential, and to be responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

5. Credits, Subscriptions, and Payments

The Service uses a credit system. Generating images consumes credits.

• Free credits: Free accounts receive a small allowance of credits each month to try the Service.
• Subscriptions (Pro, Max): Subscribers receive a monthly allowance of credits. Subscriptions renew automatically until cancelled and can be managed or cancelled at any time from the billing portal; cancellation takes effect at the end of the current billing period.
• Credit packages: You can also buy one-time credit packages; credits purchased as part of a package do not expire.
• Expiration: Monthly refresh and subscription credits generally expire 30 days after they are granted. Credits have no cash value and are not transferable.

Payments are processed by third-party payment providers (such as Stripe) on their own secure pages; we do not store your card details. Prices are listed in US dollars and may exclude taxes, which are calculated at checkout where applicable.

Because credits are digital goods delivered immediately, used credits are non-refundable. If you believe you were charged in error, contact us at support@robthumbnail.com and we will review your case.

6. Your Content

"Your Content" means the prompts you submit, images you upload, and images the Service generates for you.

• You retain ownership of Your Content. You may use images you generate for personal or commercial purposes, including as game thumbnails, to the extent permitted by applicable law.
• You grant us a limited license to store, process, and display Your Content solely as needed to operate the Service (for example, storing your conversation history, sending prompts to AI providers, and rendering share links you create).
• If you create a public share link for a conversation, you grant others the right to view that snapshot. You can disable the link at any time.
• You are solely responsible for how you use generated images, including making sure your use complies with Roblox's Community Standards, third-party rights, and applicable law.

7. Acceptable Use

You agree not to use the Service to create or distribute content that:

• Is illegal, or promotes illegal activity
• Depicts or sexualizes minors, or is violent or graphic in a way that violates applicable law or platform standards
• Infringes or misappropriates any copyright, trademark, or other intellectual property right
• Impersonates or defames any person or organization
• Is intended to harass, threaten, or discriminate against anyone
• Is false or misleading (for example, fake game screenshots presented as real in-game footage)

You also agree not to: misuse the Service to attack or overload our infrastructure; scrape or reverse-engineer the Service; resell access to the Service without our written consent; or circumvent credit accounting, rate limits, or security controls.

We may remove content, suspend generation, or terminate accounts that violate these rules.

8. AI-Generated Output

The Service produces images using AI models. Output may be imperfect, inaccurate, or similar to other works, and identical prompts may produce different results. We do not guarantee that any specific output is unique, commercially usable in every context, or fit for any particular purpose. You are responsible for reviewing generated images before using or publishing them.

9. Intellectual Property of the Service

Except for Your Content, the Service — including its software, design, text, and branding — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our branding or the Service beyond the access we expressly provide.

10. Service Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend, or remove features, plans, or limits at any time, including as AI provider availability and costs change. Material changes to paid plans will not apply retroactively to a billing period you have already paid.

11. Termination

You may stop using the Service and delete your account at any time from your profile settings; deleting your account also deletes your conversation history. We may suspend or terminate your access if you violate these Terms, fail to pay amounts due, or where we reasonably believe termination is necessary to protect the Service or other users. Sections that by their nature should survive termination (for example ownership, disclaimers, and limitation of liability) will survive.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated output will meet your requirements.

13. Limitation of Liability

To the maximum extent permitted by law, RobThumbnail and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months preceding the claim or USD 50.

14. Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. If a change is material, we will try to notify you (for example by email or in-product notice). Continuing to use the Service after changes take effect means you accept the updated Terms.
